Are You In Jail? Tips To Help You Get Out When You Have No Money

One of the great things about the United States is that even if you find yourself locked up in jail, you may have a way out:  Posting bail.  However, if you're going through a stressful financial time, it can be quite difficult to pull together the funds you need to be released.  If you are ever in jail and don't have the money for bail, use this information to learn more about how you can get out as soon as possible.

Consider Getting Out On Your Own Recognizance

The first step you should take when you're looking to get out of jail when you are out of money is to plead your own recognizance (O.R.)  Pleading O.R. means you recognize what you are being booked for, and that you agree to show up for your court date as scheduled.

When you plead O.R., you won't need to post bail money at all.  It is essentially your word to the judge that you will not attempt to skip town before your court date.  You can substantiate your O.R. claim even more by showing the judge that you have a job and other responsibilities that you must attend to which will keep you from trying to leave or escape before your trial date.  If you have friends or family members who are willing to vouch for your credibility, this can also go a long way toward helping you get an O.R. release.  

Keep in mind that if you have a previous criminal history, or have gone a long time without employment you may have a more difficult time getting the judge to believe that an O.R. release is the right decision for you.

Use Your Property As A Lien

Another technique you can use when you need to get out of jail is to have the courts place a lien against your property.  While you may not have any fluid cash that you can use for bail, you may have one or more pieces of property that can serve as suitable substitutes.

For example, if your bail has been set at $10,000, and you own a piece of land that is worth $100,000, that you only owe $50,000 on, that means there is $50,000 in available equity that the court can place a lien on to secure your release.  Understand that if you have a lien placed on your property and you fail to appear in court on the appointed date, the court system may have the right to seize the property.
